In order to be appointed as a Constitutional Court Judge, a candidate must fulfil the following requirements : - Hold an Indonesian citizenship;
- Hold a law degree;
- Aged at least 40 (forty) years old at the time of appointment;
- Have never been imprisoned based on a permanent court decision for committing a crime punishable by at least 5 (five) years of imprisonment;
- Not declared bankrupt by the court;
- Have the experience in the field of law for at least 10 (ten) years.
Candidates of Constitutional Court Judge are obliged to produce a letter stating their willingness to be appointed as Constitutional Court Justices. The Judge consists of 9 people, 3 (three) are nominated by the Supreme Court, 3 (three) by the House of Representatives, and 3 (three) by the President, who all to be appointed through a Presidential Decree. It will be issued at the very latest 7 (seven) days after nominations are submitted to the President. The Constitutional Court Justices are prohibited to hold the positions of : - Other state officials;
- Members of any political parties;
- Businessman;
- Advocate;
- Civil servant.
THE OATH OF THE JUDGES In accordance with the article No. 21 of the Act No. 24/2003 about the Constitutional Court, prior to taking the office, the Constitutional Court Justices shall swear an oath or a promise in accordance with their respective religions. The oath or promise shall be as follows : The Oath of a Constitutional Court Justice : In the name of Allah I swear that I will do my best in fulfilling all obligations as a Constitutional Court Justice, and I will be as good and fair as possible, abide by the 1945 Constitution of the Republic of Indonesia, and apply all legislations and laws as strict as possible in accordance with the 1945 Constitution of the Republic of Indonesia, and serve the country and the nation. The Promise of a Constitutional Court Justice : I solemnly promise that I will do my best in fulfilling my obligations as a Constitutional Court Justice, and I will be and I will be as good and fair as possible, abide by the 1945 Constitution of the Republic of Indonesia, and apply all legislations and laws as strict as possible in accordance with the 1945 Constitution of the Republic of Indonesia, and serve the country and the nation. The sworn of oath and promise mentioned above are conducted in front of the President. The Oath of the Chief/Deputy of the Constitutional Court Justice : In the name of Allah I swear that I will do my best in fulfilling all obligations as the Chief/Deputy of the Constitutional Court Justice, and I will be as good and fair as possible, abide by the 1945 Constitution of the Republic of Indonesia, and apply all legislations and laws as strict as possible in accordance with the 1945 Constitution of the Republic of Indonesia, and serve the country and the nation. The Promise of Chief/Deputy of the Constitutional Court : I solemnly promise that I will do my best in fulfilling my obligations as the Chief/Deputy of the Constitutional Court Justice, and I will be and I will be as good and fair as possible, abide by the 1945 Constitution of the Republic of Indonesia, and apply all legislations and laws as strict as possible in accordance with the 1945 Constitution of the Republic of Indonesia, and serve the country and the nation. |
