Jakarta-MKOnline, The Constitutional Court (The Court) again held a session for the review of Act Number 12 of 2008 about the Second Amendment of Act Number 32 of 2004 about Regional Government (Act on Regional Government), Wednesday (2/12),at The Court Panel Room. The Case registered with Number 141/PUU-VII/2009 was submitted by Muhammad Soleh.
In the session for verifying improved petition, the Petitioner stated that the requirement to be a head of a region from independent candidacy was considered to put too much burden.
"If we look at Article 59 paragraph (2a), (2b) (2e) then the requirement for individual candidates includes showing a valid ID dan a statement of support. That was different from the requirement to be a member of the City Council, which is easier, only showing ID," said Soleh.
Further, Soleh added that the support for regional head candidates could be in two forms, through ID card or the signed statement of support. Both had the same function that was to show whether or not the candidate was supported by the people.
"Lawmakers should have designed only one requirement either ID card or a statement of support. Still, it would be checked by the regional election commission whether or not the ID or a Statement of support really came from the people or not," Soleh pointed out.
In the Petitum, the Petitioner demanded The Court to announce Article 59 paragraph (2a) letter a, b, c, d and paragraph (2b) letter a, b, c, d so long as the phrase "have to be supported by at least 3% (three percent), 4 % (four percent), 5 % (five percent) and 6,5% (six and a half percent)"; Paragraph (2e) so long as the phrase "written in form of a letter of support accompanied with " and paragraph (5a) huruf b so long as the phrase "a statement of support attached by " within Act on 12/2008 about the second amendment of Act 32/2004 about Regional Government was against The 1945 Constitution and was not legally binding.
